Privacy Policy

ReconAI ("ReconAI," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect, how we use it, and the choices you have. By using reconai.io or our services (collectively, the "Service"), you agree to this Policy. If you don't agree, don't use the Service.

Who we are

ReconAI is a US-based business that produces monthly competitive- and customer-intelligence reports for business operators. The product is built by Jim Toth — a 20-year retired Marine pilot turned high-volume fast-food entrepreneur, with deep expertise in systems and process. Information we collect

(a) Information you give us directly:

• Your email address (when you sign up for early access, request a sample report, or contact us)
• Your name, business name, and business contact information (when you become a customer)
• Information you submit through forms, support requests, or sales conversations
• Payment information (only when you become a paying customer; processed by our payment processor)

(b) Information we collect about your business for the Service to work:

• Public information about your business locations and your named competitors (Google Place IDs, public business names, public addresses)
• Public reviews and ratings posted on third-party platforms (e.g., Google) about your business and your named competitors
• Aggregated, public information about competitive operators in your category

We don't collect non-public data about you, your customers, your competitors, or your competitors' customers. We don't access your point-of-sale, inventory, or operational systems.

(c) Information collected automatically:

• Standard server logs (IP address, user agent, timestamps) when you visit reconai.io. Used for security and basic uptime; not sold or shared.
• We do not currently use analytics cookies, tracking pixels, or third-party advertising trackers. If we add analytics, we'll update this Policy.

How we use information

We use the information we collect to:

• Operate, maintain, and improve the Service
• Generate the monthly intelligence reports you've contracted for
• Send you the reports, mid-month alerts, and Service-related communications
• Respond to your inquiries and provide customer support
• Process payments and manage your account
• Comply with legal obligations
• Detect and prevent fraud or abuse

We will never sell your personal information. We will never sell your competitive intelligence reports. We will never share the contents of your reports with anyone outside your organization without your written consent.

How we share information

We share information only in these limited cases:

Service providers that help us operate ReconAI. These include Cloudflare (hosting/DNS), Google Workspace (email/storage), Tally (form submissions), Stripe (payment processing for paying customers), and Anthropic / OpenAI / similar AI providers (used to generate report content from public data; we do not send personally identifying information about you or your customers to these providers — only public business and review data). These providers are contractually limited to using your information only to provide services to us.

Legal compliance. We may disclose information when required by law, court order, or to protect our rights, your safety, or the security of the Service.

Business transfers. If ReconAI is involved in a merger, acquisition, or sale of all or part of its assets, your information may be transferred. We will notify you and provide options if so.

We do not share your information with third parties for their own marketing purposes.

Payment data

Payment information (card numbers, billing details) is processed directly by Stripe and is never stored on ReconAI servers. Stripe is PCI-DSS compliant. We retain only billing metadata (transaction ID, amount, date) for accounting and tax purposes.

Your rights

Depending on where you live, you may have the right to:

• Access the personal information we hold about you
• Correct inaccurate information
• Delete your information (subject to legal retention obligations)
• Object to or restrict how we use your information
• Receive a copy of your information in a portable format
• Opt out of marketing communications (every marketing email includes an unsubscribe link)

California residents have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the rights listed above plus the right to opt out of the "sale" or "sharing" of personal information. ReconAI does not sell or share personal information as those terms are defined under CCPA/CPRA.

To exercise any of these rights, email jim@reconai.io. We'll respond within 30 days.

Data retention

• Account information: retained while your account is active and for 7 years after closure (tax/accounting requirements)
• Report data: retained for the duration of your subscription plus 90 days after cancellation, then deleted
• Email subscribers (non-customers): retained until you unsubscribe, then deleted within 30 days
• Server logs: 90 days

You can request earlier deletion at any time by emailing jim@reconai.io.

Security

We protect your information with industry-standard administrative, technical, and physical safeguards. These include encryption in transit (TLS), encryption at rest where applicable, access controls, and regular security reviews. No system is perfectly secure; we'll notify you in compliance with applicable law if we ever suffer a breach affecting your information.

Children

ReconAI is intended for business use by adults. We do not knowingly collect personal information from anyone under 16.

International users

ReconAI is operated from the United States. If you access the Service from outside the US, your information will be transferred to and processed in the US, which may have different data protection laws than your country.

EU / UK residents: ReconAI does not currently market to or accept customers in the European Union or United Kingdom and has not designated a representative under Article 27 GDPR. If you are an EU or UK resident, please do not submit personal information through this site. If you do, we will use it solely to respond to your inquiry and will delete it on request.

Cold outreach (CAN-SPAM)

If we email you cold (without prior signup) for sales purposes, every email will identify itself clearly as a sales message, include our valid contact information, include a working unsubscribe mechanism, and honor unsubscribe requests within 10 business days. If you'd prefer never to be contacted, email jim@reconai.io with "UNSUBSCRIBE" in the subject and we'll add you to a permanent suppression list.

Changes to this Policy

We may update this Privacy Policy from time to time. We'll post any changes here and update the "Last updated" date. Material changes will be communicated via email to active customers at least 30 days before taking effect.

Assistant Privacy

Every paid Recon subscriber gets a private chat at reconai.io/a/. Here's exactly what we keep and what we don't.

What we don't keep

We don't keep the words you type. Not in a database, not in a log, not anywhere. When you close the tab, the conversation is gone. We can't read it after the fact, and neither can anyone else — there's no replay button, no admin panel, no archive.

What we do keep

Two small things, both per-customer:

• A count of how many times you've used the assistant this month (so we can show you "23 / 100" in the corner).
• A short list of the types of things you've asked about — e.g. "review-reply," "promo-planning," "competitor-research" — with no specifics. We never keep names, emails, phone numbers, or any other personal information from anything you paste.

That second list is what makes each month's report lean toward what you actually use. The more you use the assistant for promo planning, the more your next report focuses on promos.

If you paste a review, an email, or something with personal info

The assistant uses it to help you with that one answer. Then it's gone when you close the tab. We never store it, never train any model on it, and never see it after your session ends. The topic tagger is explicitly instructed to strip names, emails, and phone numbers before writing the type-of-thing tag we keep — and a sanitization pass runs on top of that as a backstop.

How to revoke your access

Reply to your latest report with the word cancel (per the cancellation policy in the Terms) and your assistant link stops working within a minute. Your context file in our system is deleted at the same time.

If your link leaks

Tell Jim. We mint a new link in about 30 seconds and disable the old one. A leaked link only ever exposes one customer's own business profile (the same one we emailed you) — never anyone else's.

Terms of Service

These Terms of Service ("Terms") govern your access to and use of reconai.io and the services, reports, and features made available by ReconAI ("ReconAI," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you don't agree, don't use the Service.

The Service

ReconAI provides monthly competitive- and customer-intelligence reports and related analyses to business operators. The Service is delivered via email and online channels. Specific features and deliverables are described at reconai.io and in the order form or proposal you sign with us.

Eligibility

You may use the Service only if you (a) are at least 18 years old, (b) have the authority to bind the business you represent, and (c) are using the Service for legitimate business purposes. The Service is not intended for personal, family, or household use.

Account registration

To use paid features, you must create an account. You agree to provide accurate, current information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Subscription, payment, and renewal

Plans and pricing. Current plans and pricing are described on reconai.io or in your order form. We may change pricing for future billing periods with at least 30 days' notice; existing subscriptions will not see price changes until renewal.

Billing. Subscriptions are billed in advance on a monthly or annual basis (as selected at signup). Payment is due immediately on the invoice date.

Auto-renewal. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel anytime by emailing jim@reconai.io.

Refunds. Monthly plans: no refunds for partial months; cancellation takes effect at the end of the current billing period. Annual plans: prorated refunds within the first 30 days of the initial term, no refunds thereafter.

Failed payments. If a payment fails, we'll attempt to retry. If we can't collect payment within 14 days, we may suspend or terminate your access until payment is current.

Acceptable use

You agree NOT to:

• Use the Service in any way that violates applicable law
• Reverse-engineer, decompile, or attempt to extract source code or proprietary methodology from the Service
• Resell, redistribute, sublicense, or otherwise share the reports or any part of them with third parties outside your organization without our prior written consent
• Use the Service to compete with ReconAI (e.g., to build a copycat intelligence service using our outputs)
• Use the Service, the reconai.io website, the reports we deliver, or any visible structure, methodology description, or output format thereof — in whole or in part — as input or training data for any artificial intelligence system, machine learning model, or automated tool whose purpose is to replicate, reproduce, or build a service substantially similar to ours. This restriction applies whether you operate the AI system yourself, employ a third party to do so, or use a publicly available model, and includes any use of large-language models, code-generation systems, or design-replication tools to clone the Service's appearance, content, methodology, deliverables, or pricing structure.
• Submit false, misleading, or unauthorized information about competitors or other parties
• Use automated tools (scrapers, bots) to access the Service except via APIs we explicitly provide
• Attempt to gain unauthorized access to other accounts, systems, or data
• Interfere with the Service's operation, security, or other users' access

We may suspend or terminate accounts that violate these rules, with or without notice.

Your data and content

Your data stays yours. You retain all ownership rights in the information you provide to us — your business information, the names of your tracked competitors, any feedback you give us about reports.

License to operate the Service. You grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze your data solely to provide and improve the Service.

Public data. Our reports are based on publicly available information about your business, your named competitors, and the broader market. We do not represent that such public information is accurate, complete, or current; we provide the analysis on an as-is basis.

Aggregated and de-identified data. We may use aggregated, de-identified information (information that no longer identifies you or your business) for any purpose, including improving our methodology and publishing market-level insights. We will never share data in a way that identifies you without your consent.

Our intellectual property

The Service, the report templates, our methodology, our software, our brand, and any content we create are owned by ReconAI and protected by copyright and other IP laws. You receive a limited, non-exclusive, non-transferable license to use the reports we deliver to you for your internal business purposes.

You may NOT reproduce or redistribute reports outside your organization without our written permission, republish reports or excerpts publicly, use our brand or trademarks without permission, or train AI models on our reports or methodology.

Warranties and disclaimers

The Service is provided "as is" and "as available." We make no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Specifically, ReconAI does NOT warrant that the Service will be uninterrupted, timely, secure, or error-free; that the information in any report is accurate, complete, current, or reliable; that the reports will produce any particular business outcome; or that the Service will meet your specific business needs.

ReconAI is an analytical tool, not a guarantee of business results. Your business decisions are yours. Reports are inputs to your judgment; they are not directives, recommendations to buy or sell anything, or substitutes for professional advice.

Limitation of liability

To the maximum extent permitted by law: ReconAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost business opportunities, or reputational harm. Our total cumulative liability to you for any and all claims under these Terms or related to the Service shall not exceed the greater of (i) the amount you paid us in the 12 months preceding the claim, or (ii) one hundred US dollars ($100). These limitations apply even if we have been advised of the possibility of such damages and even if a remedy fails of its essential purpose.

Some jurisdictions don't allow the exclusion of certain warranties or limitations of liability — those exclusions may not apply to you to the extent prohibited by law.

Indemnification

You agree to indemnify and hold harmless ReconAI from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service in violation of these Terms or applicable law, your violation of any rights of a third party, or any data, content, or competitor information you submit to the Service.

Term and termination

These Terms are effective when you first use the Service and continue until terminated. You may terminate at any time by canceling your subscription. We may suspend or terminate your access immediately if you breach these Terms, fail to pay, or use the Service in ways we reasonably believe pose risk to us, other customers, or third parties. On termination, your right to access the Service ends, you remain responsible for any fees accrued before termination, and we may delete your account data 90 days after termination (you can request earlier deletion).

Changes to the Service or Terms

We may modify or discontinue features of the Service at any time. We may update these Terms; material changes will be communicated by email to active customers at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.

Disputes

Informal resolution. Before filing any legal action, you agree to first contact us at jim@reconai.io and try to resolve the dispute informally for at least 60 days.

Governing law. These Terms are governed by the laws of California, USA, without regard to conflict-of-laws principles. We reserve the right to add binding arbitration and venue terms in a future revision; any such terms will be communicated to active customers by email at least 30 days before taking effect.

General

These Terms, together with our Privacy Policy and any order form you sign with us, constitute the entire agreement between you and ReconAI regarding the Service. If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our prior written consent. Neither party is liable for delays or failures due to events outside its reasonable control. We send notices to the email address on your account; you send notices to jim@reconai.io.
